2024 TENTATIVE MOWING CONTRACT



AGREEMENT THIS AGREEMENT, made this ______ day of April 2024, by, between and among: THE LINESVILLE CEMETERY ASSOCIATION, INC., of Linesville, Crawford County, Pennsylvania -and- -------------------------------------------------------------------- of --------------------------, (hereinafter sometimes referred to as “ Mowing Contractor”. as follows:

Whereas, the Linesville Cemetery Association, Inc. is the owner of the Linesville Cemetery located in the Borough of Linesville adjacent to Wallace Avenue Extension and has the responsibility to see to the maintenance of the Linesville Cemetery; and,

Whereas, Mowing Contractor has agreed to supply the maintenance of the cemetery as hereinafter set forth;

Now Therefore, the parties to this agreement do hereby set forth their understanding and agreement of the work that is to be done by Mowing Contractor and the compensation he or she is to receive for said work as follows:

1. The term of this agreement shall be from May 1, 2024 to September 30, 2024

2. Mowing Contractor will receive as compensation for the work set forth below the sum of _______________________________DOLLARS ($__________.00) and he will be paid each month beginning in May, 2024 the sum of ___________ DOLLARS ($_____.00) per mowing, times the number of mowings each month. Payment will be made at the end of each month. In the event the contract is terminated prior to the end of mowing season (October), or the number of mowings per month are not as set forth below, the mowing Contractor will be paid, prorata, only for the mowings and other work actually completed.

3. Mowing Contractor shall mow the cemetery a total of seventeen (17) times during the grass growing season, specifically; four (4) times during the month of May; four (4) times during the month of June; three (3) times during the month of July; three (3) times during the month of August; three (3) times during the month of September. Each of the mowings shall occur at least seven (7) days after the previous mowing and not more than ten (10) days after the previous mowing. The first mowing shall occur on or after the 1st of May and last mowing shall occur on or before September 30th. The mowing contractor shall mow the Cemetery the Wednesday through Friday period immediately preceding Memorial Day.

4. Mowing Contractor agrees that prior to each mowing he or she must prepare the ground for mowing by removing debris from the cemetery as well as removing floral arrangements left in the cemetery after funerals. It will also be required that the trash in cans provided by the Cemetery Association be emptied at the time of each mowing. The trash shall be bagged and the bags placed at the front gate.

5. Mowing Contractor agrees that each mowing will consist of mowing the cemetery, trimming the cemetery, including appropriate trimming around each monument and any other structures located within the cemetery.

6. After mowing, the monuments, stones and grave markers will be cleaned by removing cut grass from the surfaces of the monuments, stones and grave markers.

7. The Mowing Contractor shall maintain Liability Insurance and name the Linesville Cemetery as an additional insured, with a certificate of insurance provided to the cemetery at time this contract is executed.

8. Approximately once each month Mowing Contractor agrees to weed eat the water meter site located adjacent to N. Mercer Street so that the meter can be read.

9. Either party to this agreement may terminate their responsibilities by giving the other party at least ten (10) days written notice of their intention to do so. In the event of the breach of this agreement by either party, the responsibility of the other may be terminated immediately and the remedy of contract termination will not in any way diminish the rights of the parties to damages pursuant to law.
