He was mustered into service December 6, 1862. A note in the pension application packet from Gabriel Carnes and Nathaniel Walter McKinney states that Benjamin contracted a severe cold that he could not overcome, and on the march to Gettysburg he was taken by ambulance to a camp hospital, then transferred to a hospital at Gettysburg. Benjamin died January 4, 1864 of capillary bronchitis at the U.S. General Hospital in Philadelphia - also called Broad Street General Hospital.
Benjamin's widow quickly remarried (she was left with a two-year-old child to care for) and was not eligible to receive his military pension, but the child, Sarepta Davis was. The pension application packet is quite lengthy (45 pages) and a very interesting read. I have only submitted small portions below here. The packet includes such interesting information such as when Benjamin and Elizabeth were married and by whom, who the witnesses to the marriage were, Elizabeth's actual marriage license to her second husband Harmon Smith. A great read!
